Bio:Bingham Studies Palo Alto Student Assignment Plan July 8, 2013 - A Bingham team partnered with the Lawyers' Committee for Civil Rights to draft a comprehensive policy report, Pushing the Line, which analyzes the Sequoia Unified School District's student assignment plan in Palo Alto, Calif. The team included partner Frank Kennamer; counsel Bess Kennedy; associates Thai Le and Ali Gramaglia; and summer associate Steven Erkel. Through a maze of attendance boundaries, the current student assignment plan divides minority students from East Palo Alto between three different high schools across non-contiguous attendance zones. As a result, the district's process for assigning students to high school may be discriminatory. The report outlines how the district's assignment plan potentially runs afoul of civil rights law. Federal and state anti-discrimination statutes prohibit the district from implementing policies that have an unjustified, adverse impact on students of color, regardless of intent. The team summarized applicable educational policy research, analyzed relevant data and noted the legal implications of the district's current assignment plan.
