Practice Areas:We have a combined over 20 years of experience in representing clients in family law, criminal law and education law related matters. We have represented hundreds of individuals facing a variety of different legal matters, and have extensive experience in the following areas: Family Law – McIntyre DeFede Law PLLC will fully analyze your case and develop a strategy from the outset. Too often family law attorneys prepare for trial at the last minute when it is clear settlement isn’t possible, which results in higher fees and a weaker trial position. Our attorneys make sure that every necessary step is taken to protect you in the event your case ultimately isn’t able to settle. We represent clients in both contested and uncontested cases, from drafting a simple settlement agreement to a multi-day equitable distribution trial. Each divorce is as unique as the parties involved and we will treat your case with the respect that it deserves. The one area in which our approach never changes is in custody cases, where we will always develop a strategy that focuses on the best interests of your children. Criminal Law –McIntyre DeFede Law PLLC represents clients in a wide variety of criminal charges, both misdemeanors and felonies, in the state and Federal courts. We have a special emphasis on juvenile law, stemming from our experience with disabilities and mental health issues that impact youth. There are many types of actions that can be filed in Juvenile and Domestic Relations District Courts beyond custody or criminal cases, including CHINS, abuse and neglect petitions, termination of parental rights, and mental health commitments, and we are experienced in all of them. Education (School) Law – Most of our clients in the practice area of education law never imagined they would need an attorney, but suddenly find themselves in a confusing and unfamiliar situation. In this area, we serve both students and teachers with an emphasis on the following: Special Education: Our attorneys represents parents of students with disabilities at all levels of the special education process, including initial eligibility, IEP meetings, placement decisions, administrative reviews, mediation and ultimately due process hearings. Although we primarily represent clients in Northern Virginia, we have cases throughout the Commonwealth with the ability to attend IEP meetings by telephone. Discipline: Students who are recommended for long term suspension or expulsion from school have certain rights, including a hearing before the Superintendent and/or School Board of your school district. We are familiar with the administrative hearings in all of Northern Virginia and will be able to tailor your approach accordingly. Post-secondary students: Our attorneys have represented students across the Commonwealth on honor code violations, discipline matters and requests for in-state tuition. One of the most important things a student can do is to consult with us before completing the application to request a change in status from out-of-state to in-state tuition. Teachers: We represent teachers who face termination or other discipline action, including grievance hearings. Teachers also rely on our firm’s expertise when it comes to dealing with a Child Protective Services investigation. Our attorneys are familiar with the impact a CPS finding will have on a teacher and the appeals procedures which need to be followed. At McIntyre DeFede Law PLLC, we strive to be accessible and to make an overwhelming or complicated legal situation understandable so that our clients can make great decisions and feel in control of their lives.
