Bio:D. Pickett Wins 9th Circuit Pro Bono Victory July 17, 2013 - Bingham, led by partner Donn Pickett, obtained a significant victory for client Andrew Rick Lopez in the 9th Circuit. Lopez, a prison inmate, alleged that as retaliation for exercising his First Amendment right to file grievances and lawsuits, prison officials validated him as a gang member and placed him in a security housing unit for more than 12 years without first affording him due process. In July, the 9th Circuit ruled in favor of Lopez, affirming that inmates must be told why they are being validated before validation occurs. The court also granted Lopez relief on other issues that prevented him from receiving a fair trial. Specifically, at trial the district court judge allowed Lopez's only witness to refuse to testify upon invoking the Fifth Amendment. The witness claimed he feared administrative consequences from the prison as the result of his testimony. The 9th Circuit held that the trial court's ruling was prejudicial error because the witness did not fear criminal prosecution and Lopez was deprived of presenting evidence on the intent of a prison official who allegedly retaliated against him. Also at trial level, the district court judge dismissed a defendant on the grounds that the claims against him were duplicative.
