Bio:Daily Journal, April 22, 2013 - The U.S. Environmental Protection Agency's (EPA) efforts to police the cleanup of hazardous waste sites through cost-recovery litigation have been integral in addressing some of the most polluted locations in the country. Still, some lawyers involved in the litigation believe that the EPA could be hamstrung in bringing as many suits in the future. Federal budgets constrained by sequestration, combined with an interagency snafu in the recently decided Rialto case, have some speculating there could be a moratorium on cost-recovery actions for the foreseeable future.Rialto was ostensibly a $50 million victory for the EPA, but that victory is tainted by the fact that some $20 million of the $50 million recovered for cleanup is due from the Department of Defense because of its association with rocket manufacturing at the Rialto site. Partner Jim Dragna does not believe, however, that the EPA will stop bringing its cases anytime soon. The program is old enough now that we've had a couple economic and political cycles, and the EPA has been pretty consistent with its cost-recovery actions, he said.
