Bio:June 12, 2012 - Bingham obtained a resounding Second Circuit Court of Appeals' victory on behalf of First Frontier, L.P., a former sub-feeder fund into Bernard L. Madoff Investment Securities LLC. The plaintiffs, investors in the fund, argued that First Frontier knew or should have known that Madoff was a fraud. The court affirmed the district court's dismissal of the plaintiffs' complaint, holding that the plaintiffs had not satisfied the scienter element required for each of their claims. The court also held that the plaintiffs failed to allege that First Frontier had a motive to commit fraud. The fund's only compensation was a fully disclosed and unremarkable management fee, but if First Frontier's fee could support an allegation of motive, the court explained, then no company would be free from aspersions of fraud. The plaintiffs similarly failed to allege that First Frontier had been consciously reckless; although the plaintiffs enumerated various Madoff-related red flags, they did not allege that First Frontier had even been aware of them.
