Bio:Law360, July 17, 2012 - The Ninth Circuit ruled on July 16 that two Cyprus-based oil brokers cannot pursue $6.25 million in claims against the Republic of Iraq for terminating contracts for the sale and purchase of Iraqi oil. Because allegations in the suit weren't based on U.S commercial activity by Iraq, sovereign immunity applied. In a 2-1 published decision, the majority disagreed with a ruling by U.S. District Judge Consuelo B. Marshall of California who had said that Iraq's sovereign immunity defense to the claims of oil brokers Pentonville Developers Ltd. and Marblearch Trading Ltd. under the Foreign Sovereign Immunities Act was barred by a commercial exception, denying Iraq's attempt to end the case. The Republic of Iraq was represented by partner Susan Hoffman and of counsel Robert Brundage, along with former Bingham lawyer Ed Powers.
