Bio:Team Represented DIP Lenders in Bankruptcy Case The Deal Pipeline, Dec. 23, 2009 - TLC Vision (USA) Corp. kicked off its bankruptcy case on Dec. 22, by securing court approval to borrow from a $15 million debtor-in-possession loan, reported the Deal Pipeline. The U.S. Bankruptcy Court for the District of Delaware in Wilmington approved the financing during a hearing on first-day motions. The order allowed TLC Vision to access $7.5 million from the Cantor Fitzgerald Securities-led DIP. TLC Vision, a Missouri eye-care company; affiliate TLC Management Services Inc.; and Ontario parent TLC Vision Corp. filed Chapter 11 petitions in Delaware on Dec. 21. TLC's bankruptcy filing followed two consecutive years of losses and an inability to tap into credit markets to refinance a debt burden it could not shoulder. Instead of refinancing its debt, TLC entered bankruptcy with a prenegotiated plan to swap about $101 million in outstanding first-lien debt for all of its new equity and $80 million in new senior notes (to be issued in separate $50 million and $30 million tranches).
