A lending institution retained Attorney Christopher R. Nicolopoulos in a small claims suit against me for a deficiency balance on an auto loan almost 6 (six) years after the default occurred. I informed both his client as well as Mr. Nicolopoulos that the statute of limitations applicable in this case (written contract in NH -3 years) had expired. The court dismissed the action against me. Mr. Nicolopoulos proceeded to file a motion to reconsider in which he referenced the original agreement (which he forgot to include and subsequently mailed a day later), claiming that because the word "seal" was affixed to the agreement that it was a contract under seal and subject to a 20 year statute of limitations. (I am sure this cost his client a pretty penny for this "hail mary" play.) Upon what little part I could see of the agreement, I noticed it was a motor vehicle installment agreement which was subject to the U.C.C. Statute of limitations (4 years) and that period had long expired. The court dismissed his motion to reconsider. (I wonder if he and his client are aware of the $1,000 penalty in NH for filing a frivolous claim). I am not an attorney. I do not have any formal legal training and yet was able to ascertain that the applicable statute of limitations had expired and that there was no basis in law for this claim. (His client should be thankful for the internet as had I been forced to hire an attorney, the law states those fee's (reasonable) would have been owed as a penalty as well.) Statutes of Limitations are usually checked prior to many other facts in a case by attorney's and yet Mr. Nicolopolous was unable to apply the correct one. Hopefully his client was on a contingency basis and did not pay for this horrible representation
