Bio:Schwarz Discusses Impact of FMLA, ADA on Employers Law360, May 10, 2013 - Employers are dealing with a surge in leave requests from workers whose rights to time off have expanded under state and federal law in recent years. The U.S. Department of Labor has issued regulations expanding the Family and Medical Leave Act (FMLA), which guarantees covered workers unpaid leave, and has changed the Americans with Disabilities Act (ADA) to broaden the definition of what constitutes a disability. As a result, businesses and employers that want to maintain control over their workplaces and ensure some predictability on the staffing front must be proactive. Because managers and supervisors are an employer's front line in dealing with leave requests, for example, they need to be taught to look for signals that an employee's situation implicates leave or disability laws. It's certainly important for people who represent the company to be alert to communications that amount to requests for accommodation or requests for leave, said partner Doug Schwarz. Many believe that just as sexual harassment training is commonplace, training on recognizing potential ADA or FMLA issues should be looked at the same way. Although the FMLA is challenging, said Schwarz, it's relatively clear compared to the ADA, which requires individualized assessments and judgment calls.
