- Will Fraud - - Thomas Testa - 5/21/2022 - flag as inappropriate - comment
Questionable Ethics On May 21, 1999, he created a Will for my late Uncle, in this Will, Ennis changes the first name of one of my Aunt's and she is bequeathed amongst other things his "interest" in "that" real estate located at 80 Windmill Street in Pawtucket. There is no specific amount listed for the amount of "interest" my Uncle had in this property, if any. The Will is very specific with all bequests, everyone is specifically named in this Will and in closing it has an additional odd disclaimer. He intentionally and specifically disinherits each and any and all persons who may claim to be or who may be lawfully determined to be his heirs at law. Are they talking DNA testing? Why would that be an issue? This lawyer then created a Will for my Aunt in 1999, after my Uncle passed and here is where the serious legal issues arise. In this Will this attorney claims that my Aunt is the Sole owner of this property. This Will remains in tact for 17 years. In 2016, this woman's niece forces her Aunt to change her Will and disown four of this niece's siblings because she isn't speaking to them and it's more money this niece will inherit. In this new Will, my Aunt doesn't leave the property to anyone against the niece's wishes, she wanted the house left to her. The issue surrounding the property is that according to a Will probated in Pawtucket on June 21, 1982 by this lawyer himself, this Will belonged to my late Grandmother. In her Will, section 3, she bequeaths "all the residue and remainder of her estate whether real, personal or mixed and wheresoever situate unto her beloved children" and she lists her five children, it continues ... "to have and to hold unto them, their heirs and assigns forever." This probated Will was ignored by this lawyer creating my Aunt's Will which listed her as the sole owner of the property in question. The probated 1982 Will of my grandmother establishes that my Aunt was not the sole owner of the property. In fact according to that Will, there are currently 7 owners by way of their deceased parents named in my grandmother's Will that are all part owners of this property. The niece of my Aunt, got rid of him as an attorney because he didn't have my Aunt leave her the house and she went to another attorney when my Aunt was 96 years old and forced her to make a Trust leaving her a large sum of money and the property in question. The reason a Trust was made is because it doesn't pass through Probate Court and a Judge wouldn't see that the niece was the only one to benefit from these changed Wills. This lawyer has violated RI Law in not determining the rightful owner of the property in question and he has no one to blame for this mistake because he probated my grandmother's Will in 1982 which clearly stated in a legally binding manner that this property was left to all her children, their heirs and assigns forever. My Aunt passed away on December 23, 2021 at age 96, and the niece has put the house on the market, an offer has been accepted. The legal issue is that the niece isn't the legal owner of this property according to my grandmother's Will probated by this attorney in 1982. It turns out that there was a family secret that has been taken to the grave and that this lawyer is privy to, that's why he refused to acknowledge my late grandmother's Will to establish proper ownership of this property. By the grace of God and the heavens the secret has been revealed and I know all about it. I personally placed a call to this attorney last week to which he unprofessionally hung up on me without first listening to my concerns. As an officer of the courts he has failed my family and my Aunt's estate, he has violated the law in RI and if he could make errors like this in estate planning, God only knows how many other estates he has put in legal jeopardy. If this attorney has any professional ethics or any integrity, he will make contact with me and my family to right the wrong he has committed.
