In Feb. 2024 NC Superior Court Judge Hoyt G. Tessener was assigned to decide my case against the HOA of my neighborhood where I have resided for more than 15 years. Judge H. Tessener does not own any property in Wake County and likely have never participated in a HomeOwner's Association. He admitted the HOA Board made many mistakes in failing to hold elections, failing to follow HOA Rules, and intentionally discriminating against specific homeowners. He recognized the HOA Board did not begin to attempt to follow HOA Rules until they were sued by a homeowner. However, Judge Hoyt Tessener's decision was to support the Board's violations by deciding the unelected Board members had no liability in their discriminatory decisions against the plaintiff. Due to uncertain court scheduling, another homeowner who would have testified to being abused by the HOA Board could not attend due to work scheduling. This means according to this Judge and NC Law the only way a homeowner can protect their own rights as a homeowner is to spend $20.000 -$25,000 thousand dollars suing his/her own neighbors to ensure they will follow the HOA Rules & Regulations. Should the Board begin to make some effort to follow HOA Rules after being sued by the homeowner, this judge will not hold the Board members responsible for their derelict actions.
