Bio:McGrath Obtains Victory for General Motors July 11, 2012 - Bingham obtained a significant victory on behalf of General Motors (GM) in a suit brought by a New York Chevrolet dealer asserting multiple statutory, contract and common law claims, which could have implications for many of the dealers that survived the GM bankruptcy proceedings. The dealer had agreed to meet certain performance benchmarks as a condition of retaining its Dealer Agreement after the old GM filed for bankruptcy protection and sold all of its assets to the new GM. Having failed to meet those benchmarks, the dealer brought suit, alleging constructive termination and challenging the reasonableness of GM's vehicle allocation system and the methodology it uses to evaluate dealer performance nationally. After removing the case from New York Supreme Court to the Southern District, Bingham successfully opposed the dealer's motion for preliminary injunction enjoining the future termination of the Dealer Agreement and then convinced the court to permit only limited discovery before entertaining GM's motion for summary judgment. In a bench ruling, the court granted GM's motion in its entirety, dismissing the dealer's claims. Although the court has agreed that the dealer may seek to amend its complaint, it has narrowly restricted the type of claim the dealer may assert and the relief it may seek.
