Barry prepared a letter to my HOA and gave me 24 hours to review it or he would send it as is. (I personally drafted the two arguments for the letter and asked to see the final product before it was sent.) Not only did I find numerous typos but I found several instances where Barry failed to correctly cite the law. In fact, I ended up finding over a dozen errors in the 2.5 page letter. Shockingly, Barry never apologized for his errors. Later, when opposing counsel asked Barry to seek my approval for the mediator they suggested, Barry, without consulting me, falsely claimed that I agreed to the mediator. It was at that point that I fired Barry as he had never consulted with me about the mediator, much less informed me of the mediator's pros and cons. (It is extremely unusual for a plaintiff's attorney to readily agree to the first mediator suggested by a defendant's legal counsel.) During that conversation I told Barry I was annoyed that he never took ownership for the very sloppy letter he prepared to my HOA. Barry claimed it was a "draft" (as though sending a sloppy draft to a client is acceptable). When I reminded Barry that he had given me 24 hours to respond or he would send the letter as is, he had nothing to say. Even more shocking than Barry's work product is his billing practices. Among other things, he charged me for the letter in which he falsely claimed I agreed to mediation with a particular mediator. (As an aside, I have since learned that this mediator is avoided by plaintiffs' attorneys.) Barry also charged me for revising his letter to the HOA that contained all the errors I pointed out. I am so sorry to have to post this information but I strongly encourage anyone reading it to seek someone else if they require legal help.
