In its unanimous decision, the high overruled three prior Superior Court opinions. The issue was whether a DUI offender may be sentenced as a repeat offender if there was no conviction between the first offense DUI and a subsequent offense occurs when someone is arrested on a DUI charge, but not yet found guilty.
